Case Overview
After a trial court found that Louisiana State University鈥檚 expulsion of two dental students violated their constitutional due process rights, the university sought 鈥 and was granted 鈥 a 鈥渟uspensive appeal鈥 that would delay the trial court鈥檚 order that the students be reinstated until after the university had exhausted its appeals. FIREargued that if universities can exclude students whose expulsions were unconstitutional throughout years of appeals, universities will be empowered to violate students鈥 rights with impunity.
