Superior Charter Township, Michigan: Town Clerk bans campaign literature inside polling precincts

Cases

Case Overview

FIRE Victory closed

In August 2024, the Superior Township Clerk published a post-election report which highlighted a directive she issued to election workers. Per the report, she instructed staff not to allow campaign literature inside polling precincts.

On October 16, FIREwrote to Findley explaining that the First Amendment and Michigan law protect voters鈥 rights to privately use campaign literature inside the privacy of a voting booth as long as it is concealed from the public in the polling precinct. Any outright ban on campaign materials in a polling precinct would be considered an 鈥渦nreasonable鈥 restraint on free speech. Findley responded to FIREand stated she misspoke in her report and that her directive was to ban unconcealed campaign literature.
