William Paterson University Tramples Student's Constitutional Rights
WAYNE, N.J., July 20, 2005鈥擶illiam Paterson University in New Jersey has convicted student employee Jihad Daniel of 鈥渄iscrimination鈥 and 鈥渉arassment鈥濃攚ithout due process鈥攆or describing homosexuality as a 鈥減erversion鈥 in a private response to a professor鈥檚 unsolicited announcement of a university event that promoted a positive view of lesbian relationships.
鈥淲illiam Paterson鈥檚 punishment of Mr. Daniel is a direct attack on freedom of speech,鈥 remarked David French, president of the Foundation for Individual Rights in Education (果冻传媒app官方), which intervened on Daniel鈥檚 behalf. 鈥淔or the university to convict a student of 鈥榟arassment鈥 for sending a single, non-threatening e-mail dangerously trivializes real harassment.鈥
Daniel鈥檚 鈥渙ffense鈥 took place on March 8, 2005, when he responded to an unsolicited e-mail from Professor Arlene Holpp Scala, chair of the department of women鈥檚 studies, about a viewing and discussion of a film described as 鈥渁 lesbian relationship story.鈥 Daniel privately replied to Professor Scala, requesting that he not be sent 鈥渁ny mail about 鈥楥onnie and Sally鈥 and 鈥楢dam and Steve.鈥欌 Daniel went on, 鈥淭hese are perversions. The absence of God in higher education brings on confusion. That is why in these classes the Creator of the heavens and the earth is never mentioned.鈥
On March 10, Professor Scala filed a complaint with the university鈥檚 Office of Employment Equity and Diversity, accusing Daniel of violating university nondiscrimination policy because his message 鈥渟ound[ed] threatening鈥 and because she didn鈥檛 want to 鈥渇eel threatened at [her] place of work when [she] send[s] out announcements about events that address lesbian issues.鈥
Director of Employment Equity and Diversity John I. Sims subsequently proceeded to 鈥渋nvestigate鈥 Scala鈥檚 complaint. On June 15, William Paterson President Arnold Speert wrote Daniel a letter of reprimand, stating that 鈥渢he investigator concluded that since the Merriam-Webster dictionary definition of 鈥榩erversion鈥欌s clearly a 鈥榙erogatory or demeaning鈥 term,鈥 Daniel therefore was guilty of violating state discrimination and harassment regulations. The president also wrote that the letter of reprimand would be placed in Daniel鈥檚 permanent employee file.
Daniel contacted FIREfor assistance and appealed Speert鈥檚 decision on First Amendment grounds. President Speert responded that the constitutional argument was 鈥渂eyond the scope of this finding鈥 and that 鈥渢he assessed penalty of a written reprimand must, therefore, stand as issued.鈥
鈥淲illiam Paterson University is knowingly disregarding the U.S. Constitution. No one here was 鈥榟arassed鈥 or 鈥榯hreatened鈥 as defined by the law. The university simply strongly disliked a student鈥檚 point of view,鈥 remarked Greg Lukianoff, 果冻传媒app官方鈥檚 director of legal and public advocacy. 鈥淎s the Supreme Court wrote in its seminal opinion in West Virginia State Board of Education v. Barnette, 鈥榝reedom to differ is not limited to things that do not matter much. That would be a mere shadow of freedom.鈥 William Paterson鈥檚 administration would be well served by reading this compelling opinion.鈥
FIRE wrote President Speert on July 5 to protest William Paterson鈥檚 unlawful actions and to remind this public university of its obligations to protect students鈥 constitutional rights. FIREpointed out that the university鈥檚 decision 鈥渂latantly contradicts decades of Supreme Court decisions clarifying unlawful harassment and protecting freedom of expression,鈥 and that 鈥淲illiam Paterson and its administrators cannot simply choose to ignore the First Amendment when it becomes inconvenient.鈥
On July 15, New Jersey Attorney General Peter C. Harvey responded to 果冻传媒app官方, asserting that 鈥渟peech which violates a non-discrimination policy is not protected鈥 by the First Amendment. Harvey also denied that the university had violated Daniel鈥檚 due process rights, and stated that 鈥渢he recommended penalty against Jihad Daniel will stand as issued,鈥 subject to yet another appeal by Daniel.
鈥淛ust as the university is free to sponsor events discussing the issue of homosexuality, Mr. Daniel must be free to dissent. To claim that a nondiscrimination policy trumps his First Amendment rights is dishonest and unlawful,鈥 declared 果冻传媒app官方鈥檚 Lukianoff. 鈥淲illiam Paterson and the attorney general have decided that Mr. Daniel is guilty until proven innocent. FIREwill continue to fight such illiberal actions until Mr. Daniel鈥檚 rights are vindicated.鈥
