New York鈥檚 Affirmative Consent Law Affirmatively Confuses FIRE(VIDEO)
In an effort to address sexual assault on college campuses, the to pass an affirmative consent鈥攐谤 鈥攍aw this summer, putting college students at risk of punishment if they cannot demonstrate that they received 鈥渃lear permission鈥 to engage in 鈥渟exual activity.鈥 But how many students know about the new law they鈥檙e required to follow? What kinds of actions constitute sexual activity? And how exactly can they ?
FIRE鈥檚 Shelby Emmett went looking for answers from students at New York University in New York City. What she found, though, were more questions.
Many students didn鈥檛 even know the new law had been passed, while others said they heard about it only in passing.
The law doesn鈥檛 define a 鈥渟exual act,鈥 and students were split about whether something as ubiquitous as kissing counted. Answers ranged from a shaky 鈥淚 think so?鈥 to a firm 鈥渄efinitely鈥 to a non-committal 鈥渘o, not really.鈥
Some students said they used 鈥渂ody language鈥 to cue their partners about consent, while another student said the new law seems to mandate more, including 鈥渁 verbal confirmation that they鈥檙e ready to have sex with you.鈥
Yet another thought that no matter what a potential partner said鈥攅ven if he or she verbally consented鈥攕tudents had to be on the lookout for physical cues, too. 鈥淚 think a lot of the times people can say something but not really mean it,鈥 the student said.
There was also confusion about the law鈥檚 requirements when one or both parties have been drinking. The text of the law says that 鈥渄epending on the degree of intoxication,鈥 a student might not be able to consent. How drunk is too drunk?
鈥淚t鈥檚 a gray area,鈥 said one student. 鈥淚t鈥檚 hard to tell whether you鈥檙e too drunk, or whether they鈥檙e too drunk.鈥
The question that stumped students the most was how they would prove they had consent if accused of sexual assault.
鈥淚 don鈥檛 know, actually,鈥 said one.
鈥淥h my gosh. Well I think that鈥檚 really difficult because it ends up being your word against the other person鈥檚,鈥 said another.
One student in particular summed up the concern that the law simply doesn鈥檛 reflect how sex works in the real world: 鈥淚鈥檓 not gonna have everyone I sleep with sign a document saying, 鈥榊es, I consent to having sex with you.鈥欌
Under the affirmative consent standard, where one must be able to demonstrate that consent was ongoing at each step of a sexual encounter, even that might not be enough.
