LAWSUIT: FIREsues Texas university president illegally blocking charity drag show

- FIRE: The First Amendment is not optional for public university presidents. Despite Wendler鈥檚 refusal to protect the constitutional rights of his students, the First Amendment requires that the show must go on.
AMARILLO, Tex., Mar. 24, 2023 鈥 On Monday, West Texas A&M University President Walter Wendler unilaterally canceled a student group鈥檚 charity drag show fundraising for LGBTQ+ suicide prevention. Wendler said he was canceling the show because of his personal religious beliefs and because drag shows are 鈥渄erisive, divisive and demoralizing misogyny.鈥
Today, the students Wendler silenced are making sure he鈥檒l answer in court.
Represented by the 果冻传媒app官方, student group Spectrum WT and two of its student leaders sued Wendler and other Texas A&M University System officials this morning for shutting down the group鈥檚 event.
Remarkably, Wendler appeared to know he was violating the law by canceling the show. Announcing the cancellation , Wendler acknowledged the 鈥渓aw of the land appears to require鈥 him, as the leader of a public university, to permit student expression he dislikes.
鈥淧resident Wendler has made it clear to us that he knows what his legal obligations are, but he chose to ignore them, and we are thankful to FIREfor taking up our case to protect our First Amendment rights,鈥 said Spectrum WT President Bear Bright. 鈥淗opefully, this lawsuit will not just help us the LGBTQ+ students here at WTAMU protect our rights, but also help protect students鈥 rights across the U.S.鈥

FIRE鈥檚 lawsuit seeks to halt Wendler鈥檚 unlawful censorship, ensure the show will go on, and obtain damages for violating the students鈥 clearly established First Amendment rights.
鈥淐ollege presidents can鈥檛 silence students simply because they disagree with their expression,鈥 said FIREattorney Adam Steinbaugh. 鈥淭he First Amendment protects student speech, whether it鈥檚 gathering on campus to study the Bible, hosting an acid-tongued political speaker, or putting on a charity drag show.鈥
FIRE wrote to Wendler on Tuesday, reminding him that drag performances are inherently expressive acts protected by the First Amendment. FIREgave Wendler until Wednesday to confirm that he would restore the event. But Wendler gave no indication that he would stop violating the Constitution.
Wendler鈥檚 actions also violate a 2019 Texas , backed by broad bipartisan support and signed by Gov. Greg Abbott. The law states that a university 鈥渕ay not take action against a student organization or deny the organization any benefit鈥 on the basis of 鈥渁ny expressive activities of the organization.鈥
鈥淧resident Wendler isn鈥檛 just violating the First Amendment, he鈥檚 also violating Texas education law,鈥 said FIREsenior attorney JT Morris. 鈥淧ublic colleges and universities must be beacons of free expression, not Orwellian conformity centers.鈥
鈥淧resident Wendler鈥檚 edict is textbook viewpoint discrimination,鈥 said FIREattorney Conor Fitzpatrick. 鈥淲endler鈥檚 personal opinion on drag shows does not override the Constitution. The show must go on.鈥
