Free Speech Under Quarantine at University of Nevada, Reno

RENO, Nev., April 26, 2006鈥擳he Foundation for Individual Rights in Education (果冻传媒app官方) is calling for the repeal of an unlawful and immoral 鈥渇ree speech zone鈥 policy at the University of Nevada, Reno (UNR). This policy quarantines free speech at UNR to four zones covering only a small percentage of the campus and places onerous bureaucratic restrictions on speech even within these zones.

鈥淚t is simply unacceptable for a public university to transform the vast majority of its campus into a censorship area,鈥 declared FIREPresident Greg Lukianoff. 鈥淯NR鈥檚 current policy is unconstitutional and must be repealed.鈥

UNR鈥檚 policy restricts the First Amendment to four areas of campus, and requires students to obtain signed approval even for demonstrations within those areas. FIREand the ACLU of Nevada are joining students in protesting UNR鈥檚 unwarranted limits on freedom.

FIRE wrote to UNR Interim President Joe Crowley on March 31, urging him to 鈥渟pare UNR the embarrassment of fighting against the Bill of Rights鈥 and enact a policy under which 鈥渇ree speech is the norm all over the campus.鈥 FIREcited its victories against similar speech zones at Texas Tech and other public universities and pointed out that while 鈥渞easonable鈥 time, place, and manner restrictions were constitutional (for instance, restrictions on late-night noise), 鈥渢here is nothing 鈥榬easonable鈥 about transforming the vast majority of the university鈥檚 property鈥攊ndeed, public property鈥攊nto a 鈥榗ensorship area.鈥欌

FIRE also explained that the law 鈥渄oes not support the transformation of public institutions of higher education into places where constitutional protections are the exception rather than the rule.鈥 Crowley responded to 果冻传媒app官方 on April 17, claiming that UNR was 鈥渞eviewing and clarifying our understanding of time, place, and manner requirements.鈥

鈥淯NR must do far more than simply 鈥榬eview and clarify鈥 its policies,鈥 stated Lukianoff. 鈥淚t must write new ones that comply with the Bill of Rights.鈥

UNR sophomore James Girnus is a vocal opponent of the public forum policy. 鈥淚 am ashamed of our policies,鈥 he said in a speech to UNR鈥檚 student government. 鈥淚鈥檓 sure that our founding fathers would also be ashamed of the imaginary lines that UNR has drawn, telling students that once they cross the line their First Amendment rights no longer apply.鈥

FIRE鈥檚 work against so-called free speech zones began over four years at West Virginia University. After a long campaign, WVU finally abandoned its 鈥渇ree speech zones,鈥 but the trend of limiting free speech to small areas persists on many other campuses.

鈥淥ur nation鈥檚 universities are supposed to serve as the 鈥榝ree speech zones鈥 for our society. It is time that administrators remember that and stop treating free speech like a concept that needs to be feared, hyper-regulated, and restricted.鈥 Lukianoff said.
