FIRE鈥檚 Director of Policy Research, Samantha Harris, (OTL) yesterday afternoon to discuss the due process controversy surrounding Yale University鈥檚 expulsion of Jack Montague, the captain of its men鈥檚 basketball team.
from Montague鈥檚 attorney on Monday, Montague vowed to sue Yale for wrongful expulsion, calling the evidence against him far from convincing. Montague鈥檚 attorney, Max Stern, accused Yale of using Montague as a 鈥渨hipping boy鈥 after a recent report by the Association of American Universities (AAU) said Yale hadn鈥檛 done enough to combat sexual assault on campus. Stern called Yale鈥檚 decision 鈥渨rong, unfairly determined, arbitrary, and excessive by any rational measure.鈥
Sam told OTL鈥檚 Bob Ley that Yale鈥檚 are troubling. Particularly worrisome, Sam said, is the absence of an opportunity for meaningful cross-examination. Under Yale鈥檚 process, the parties may submit questions to a hearing panel to ask the other party or witnesses, but 鈥淸t]he panel, at its sole discretion, may choose which, if any, questions to ask.鈥 In a setting where there are often no witnesses, cross-examination is crucial in the search for truth.
鈥淵ou have 18, 19-year-old students essentially defending themselves against accusations of what is considered to be one of society鈥檚 most heinous crimes with very little assistance and with little to no opportunity to confront their accuser,鈥 Sam said.
Sam took issue with ESPN.com鈥檚 Adrienne Lawrence鈥檚 assertion that 鈥渁 full blown trial鈥 isn鈥檛 needed in sexual misconduct cases because 鈥渢his isn鈥檛 a judicial system, this is an academic hearing in an academic setting.鈥
鈥淚t鈥檚 not the same as 鈥 a finding of responsibility for plagiarism,鈥 Sam responded. 鈥淚t carries a tremendous stigma. As it should. But because of that stigma, and because of the seriousness of the accusations, it鈥檚 not something that campuses can afford to adjudicate without giving students very fair process which, too often, they don鈥檛.鈥
