Harassment is conduct against a person or persons based upon their legally protected class that adversely has the effect of:
i. unreasonably interfering with a person or person鈥檚 employment, educational benefits, academic grades or opportunities, or participation in University programs or activities; or
ii. unreasonably interfering with a person or person鈥檚 work or academic performance; or
iii. creating an intimidating, hostile, or offensive working or academic environment....
Sexual Misconduct is unwelcome conduct of a sexual nature when: ... ii. such conduct unreasonably (1) interferes with a person or person鈥檚 work or academic performance; (2) interferes with or limits a person or person鈥檚 ability to participate in or benefit from a work or academic program or activity; or (3) creates an intimidating, hostile, or offensive working or academic environment.
