2. Harassment on the basis of protected class: Unwelcome verbal, written, or physical conduct based on one鈥檚 protected class that unreasonably interferes with an individual鈥檚 work or academic performance or creates an intimidating or hostile work or educational environment.

  • Hostile environment is a form of harassment. Whether a hostile environment exists is determined by evaluating whether or not an individual experienced unwelcome conduct and whether or not the unwelcome conduct was, from the perspective of a reasonable person in the alleged individual鈥檚 position, sufficiently severe, persistent, or pervasive that it unreasonably interferes with, limits, or deprives an individual from participating in or benefiting from the campus鈥檚 education or employment programs and/or activities. Although repeated incidents increase the likelihood that harassment has created a hostile environment, a single or isolated incident of conduct based on protected class may be sufficient.
